AT&T gave feds access to all Web, phone traffic, ex-tech says

The 1986 Stored Communications Act forbids telephone companies and computer-service providers from giving the government records showing who customers had dialed or e-mailed without a warrant or court order. Because the law allows consumers to recover a minimum of $1,000 for each violation, AT&T and a handful of other companies could be on the hook for billions of dollars in civil liability, some experts in telecommunications law have said.

WASHINGTON — His first inkling that something was amiss came in summer 2002, when he opened the door to admit a visitor from the National Security Agency (NSA) to an AT&T office in San Francisco.
"What the heck is the NSA doing here?" Mark Klein, a former AT&T technician, said he asked himself.
A year or so later, he stumbled upon documents that, he said, show the agency gained access to massive amounts of e-mail, Web search and other Internet records of more than a dozen global and regional telecom providers. AT&T allowed the agency to hook into its network and, according to Klein, many of the other telecom companies probably knew nothing about it.
Klein will be on Capitol Hill today to share his story in the hope it will persuade Congress not to grant legal immunity to telecommunications firms that helped the government in its warrantless anti-terrorism efforts.
Klein, 62, said he may be the only person in a position to discuss firsthand knowledge of an important aspect of the Bush administration's domestic surveillance. He is retired, so he isn't worried about losing his job. He carried no security clearance, and the documents in his possession were not classified, he said. He has no qualms about "turning in," as he put it, the company where he worked for 22 years until he retired in 2004.
"If they've done something massively illegal and unconstitutional — well, they should suffer the consequences," Klein said.
In an interview this week, he alleged that the NSA set up a system that vacuumed up Internet and phone-call data from ordinary Americans with the help of AT&T and without obtaining a court order. Contrary to the government's depiction of its surveillance program as aimed at overseas terrorists, Klein said, much of the data sent through AT&T to the NSA was purely domestic. Klein said he thinks the NSA was analyzing the records for usage patterns and for content.
He said the NSA built a special room in San Francisco to receive data streamed through an AT&T Internet room containing "peering links," or major connections to other telecom providers. Other so-called secret rooms reportedly were constructed at AT&T sites in Seattle, Los Angeles, San Diego and San Jose, Calif.
Klein's documents and his account form the basis of one of the first lawsuits filed against the telecom companies after the government's warrantless-surveillance program was disclosed by The New York Times in December 2005.
Claudia Jones, an AT&T spokeswoman, said she had no comment on Klein's allegations. "AT&T is fully committed to protecting our customers' privacy. We do not comment on matters of national security," she said.
The NSA and the White House also declined to comment.
Klein is urging Congress not to block Hepting v. AT&T, a class-action suit pending in federal court in San Francisco, and 37 other lawsuits charging carriers with illegally collaborating with the NSA program. He and the Electronic Frontier Foundation, which filed Hepting v. AT&T in 2006, are urging key lawmakers to oppose a pending White House-endorsed immunity provision that effectively would wipe out the lawsuits. The Senate Judiciary Committee is expected to take up the measure today.
In summer 2002, Klein was working in an office responsible for Internet equipment when an NSA representative arrived to interview a management-level technician for a special, secret job.
The job entailed building a "secret room" in another AT&T office 10 blocks away, he said. By coincidence, in October 2003, Klein was transferred to that office. He asked a technician about the secret room on the sixth floor, and the technician told him it was connected to the Internet room a floor above. The technician handed him wiring diagrams.
"That was my 'aha' moment," Klein said. "They're sending the entire Internet to the secret room."
The diagram showed splitters glass prisms that split signals from each network into two identical copies. One copy fed into the secret room. The other proceeded to its destination, he said.
"This splitter was sweeping up everything, vacuum-cleaner-style," he said. "The NSA is getting everything. These are major pipes that carry not just AT&T's customers but everybody's."
One of Klein's documents listed links to 16 entities, including Global Crossing, a large provider of voice and data services in the United States and abroad; UUNet, a large Internet provider now owned by Verizon; Level 3 Communications, which provides local, long-distance and data transmission in the United States and overseas; and more familiar names, such as Sprint and Qwest. It also included data exchanges MAE-West and PAIX, or Palo Alto Internet Exchange, facilities where telecom carriers hand off Internet traffic to each other.
"I flipped out," he said. "They're copying the whole Internet. There's no selection going on here. Maybe they select out later, but at the point of handoff to the government, they get everything."
Qwest has not been sued because of media reports last year that said the company declined to participate in an NSA program to build a database of domestic phone-call records out of concern that it may have been illegal. What the documents show, Klein said, is that the NSA apparently was collecting several carriers' communications, probably without their consent.
Another document showed that the NSA installed in the room a Narus semantic traffic analyzer, which Klein said indicated the NSA was doing content analysis.
Steve Bannerman, Narus' marketing vice president, said the NarusInsight system can track a communication's origin and destination, as well as its content. He declined to comment on AT&T's use of the system.
Klein said he went public after President Bush defended the NSA's surveillance program as limited to collecting phone calls between suspected terrorists overseas and people in the United States. Klein said the documents show that the scope was much broader.
Global warming
Environmental extremists, notable politicians among them, then teamed up with movie, media and other liberal, environmentalist journalists to create this wild "scientific" scenario of the civilization threatening environmental consequences from Global Warming unless we adhere to their radical agenda. Now their ridiculous manipulated science has been accepted as fact and become a cornerstone issue for CNN, CBS, NBC, the Democratic Political Party, the Governor of California, school teachers and, in many cases, well informed but very gullible environmental conscientious citizens. Only one reporter at ABC has been allowed to counter the Global Warming frenzy with one 15 minutes documentary segment.

I have read dozens of scientific papers. I have talked with numerous scientists. I have studied. I have thought about it. I know I am correct. There is no run away climate change. The impact of humans on climate is not catastrophic. Our planet is not in peril. I am incensed by the incredible media glamour, the politically correct silliness and rude dismissal of counter arguments by the high priest of Global Warming.
In time, a decade or two, the outrageous scam will be obvious.

A group of 150 Israeli citizens have filed a class action suit against the Moslems who run the Temple Mount site for having destroyed Jewish antiquities there.
The suit, brought by the Shurat HaDin Israel Law Center, charges that Islamic Waqf officials have engaged in the deliberate destruction of ancient Jewish relics on the Temple Mount. The indictment was filed in the Jerusalem District Court last week, and Shurat Hadin sources say it is the first of its kind in Israeli legal history."We are utilizing a seldom-applied section of the penal code," Shurat Hadin director Attorney Nitsana Darshan-Leitner explained, "that allows private citizens to bring a criminal complaint in certain areas. If we win, the Waqf officials could face years in prison."
"Why has this never done before," IsraelNationalRadio's Yishai Fleisher asked. "Many things have never been done before," Darshan-Leitner said. "You have to think and be creative in order to do these things. Basically, it’s something that the government should have done... There are certain areas of the penal code in which private citizens are permitted to file a private criminal complaint... The Israeli government has been notified of our suit, and it has 15 days in which to decide whether it wants to pursue it on its own. If not, then we will do so on our own.She explained that the 150 plaintiffs are acting as representatives of the Jewish People, who are the owners of the Temple Mount and therefore the injured party as a result of the Waqf actions at the holy site.
"In 1967," Darshan-Leitner said, "after the Six Day War, Israel made a terrible mistake in allowing the Jordanians to continue to run the Temple Mount. It now continues to be under the custody of the Islamic Trust (Waqf), but is not owned by the Waqf; it is still owned by the Jewish people. King David purchased it, King Solomon built the Temple there, and the Jewish People have longed to return there ever since the Exile began nearly 2,000 years ago. Our regaining it in 1967 was the pinnacle of Zionism. Because it has long been the heritage of the Jewish people, anyone who violates our rights there must be stopped and punished."
The suit accuses members of the Waqf of intentionally demolishing priceless Jewish artifacts, including remains from the Second Temple. In recent months, the Waqf brought in bulldozers and heavy digging equipment to dig a long trench on the Mount, supposedly to replace electrical cables. "Israeli archaeologists who sifted through the discarded earth," the Law Center reports, "were shocked to discover a great number of Jewish artifacts brutally trashed by the bulldozers. A wall from the outer courtyard of the Second Temple is believed to have been completely pulverized.The recently accelerated destruction is part of a four-decade-long campaign by the Waqf to eradicate all evidence of the historical Jewish connection and claim to the Temple Mount," the suit maintains.
Shurat HaDin alleges that the Israeli government, in its "political cowardice," has "consistently refused to undertake any concrete actions to stop the criminal activities of the Waqf.Darshan-Leitner says, "This private suit is an unprecedented response to the brutal attempt by the Waqf extremists to eradicate any Jewish claim over the Temple Mount. The Waqf leaders belong in prison for their actions, and since Israel's government is refusing to protect Jewish heritage and property, we will prosecute the Waqf ourselves. This legal action is a moral obligation, not only for the Jewish people, but also for the Christian community, which has significant interests in safeguarding the Temple Mount as well.

Congressman Ron Paul (R-Texas) is the leading advocate for freedom in our nation’s capital. The Second Amendment
I share our Founders’ belief that in a free society each citizen must have the right to keep and bear arms. They ratified the Second Amendment knowing that this right is the guardian of every other right, and they all would be horrified by the proliferation of unconstitutional legislation that prevents law-abiding Americans from exercising this right.
I have always supported the Second Amendment and these are some of the bills I have introduced in the current Congress to help restore respect for it:
- H.R. 1096 includes provisions repealing the Brady Handgun Violence Prevention Act and the Federal Firearms License Reform Act of 1993, two invasive and unconstitutional bills.
- H.R. 1897 would end the ban on carrying a firearm in the National Park System, restoring Americans’ ability to protect themselves in potentially hazardous situations.
- H.R. 3305 would allow pilots and specially assigned law enforcement personnel to carry firearms in order to protect airline passengers, possibly preventing future 9/11-style attacks.
- H.R. 1146 would end our membership in the United Nations, protecting us from their attempts to tax our guns or disarm us entirely.
In the past, I introduced legislation to repeal the so-called “assault weapons” ban before its 2004 sunset, and I will oppose any attempts to reinstate it.
I also recently opposed H.R. 2640, which would allow government-appointed psychiatrists to ban U.S. veterans experiencing even mild forms of Post-Traumatic Stress Syndrome from ever owning a gun.
You have the right to protect your life, liberty, and property. As President, I will continue to guard the liberties stated in the Second Amendment.

April 15th, our national tax day, comes this year just as Congress prepares to pass the 2007 federal budget. If you think paying taxes was painful this year, I’ve got some bad news: the new budget is a grotesque illustration of everything wrong with the federal government. At $2.7 trillion, it’s the largest budget in U.S. history by a long shot. Like it or not, the pressure to raise your taxes will be enormous in coming years no matter who controls Congress. The amount of money government spends, borrows, and prints simply cannot be sustained.
For most people, their income tax return represents their most meaningful interaction with the federal government. It requires them to confess their actions over the past year to the IRS in excruciating detail. It's an annual ritual guaranteed to elicit strong feelings of disgust. Thanks to the deception of income tax withholding, however, some people actually look forward to tax time and a much-anticipated refund. Imagine how quickly Americans would demand lower taxes and spending if they had to write the federal government a check each month.
Most people understandably want a simpler income tax system, but it’s useless to discuss tax reform without spending reform. Who wants a 40% flat tax? Who wants a national sales tax if it adds 50% to the retail price of everything we buy? In other words, why change the tax structure if spending stays the same? Once we accept that Congress needs $2.7 trillion from us, the only question is how it will be collected. The current answer is the labyrinthine tax code, which pits taxpayers against each other in a political scramble to make sure the other guy pays. The truth is that Congress does not need $2.7 trillion, or anything close to it, to fund the proper constitutional functions of the federal government.
The only tax reform needed is to lower or abolish existing taxes. When reform proposals seem complicated, the reason is simple: they obscure their true nature as schemes to shift the tax burden around. It’s not who pays or how we pay; it’s how much we pay.
The real enemy of tax reform is the spending culture in Washington. Let me repeat: we will never have tax reform in this country until Congress changes its spending habits. The reform rhetoric, regardless of which party it comes from, never changes the reality that federal spending grows every year. Congress spent $2.4 trillion in the last Bush budget; the new budget proposes to spend $2.7 trillion. The same unconstitutional agencies are funded, the same unwise programs are perpetuated, but at higher levels than last year. The previous budget serves merely as a baseline; the only question in any given year is how much spending will increase. Once created, no spending program is ever eliminated. The cycle goes on and on, with different administrations and different people in Congress.
But could America exist without an income tax? The idea seems radical, yet in truth America did just fine without a federal income tax for the first 126 years of her history. Prior to 1913, the government operated with revenues raised through tariffs, excise taxes, and property taxes, without ever touching a worker's paycheck. Even today, individual income taxes account for only approximately one-third of federal revenue. Eliminating one-third of the proposed 2007 budget would still leave federal spending at roughly $1.8 trillion-- a sum greater than the budget just 6 years ago in 2000! Does anyone seriously believe we could not find ways to cut spending back to 2000 levels? Perhaps the idea of an America without an income tax is not so radical after all. It’s something to think about this week as we approach April 15th.

THE P.R. GUY
Over 2 years ago, I invested in this penny stock (EZTO). All tho they were not making any money, it looked to me as tho they had a good plan in which to build this company. Then they hired a P.R. guy then some good news started coming out. Buying the rights to music downloading technology.

I started accumulating more shares. Then they opened up a movie downloading site. Then an auction site.

I continued accumulating. Around this time is when I had learned that they had borrowed money from Cornell capital, to continue growing the company. Then the sites went down (off line) the PPS followed this trend. I began thinking ,at this time there either revamping or this was a scam. Then I discovered the world of investors message boards. I found that this P.R. guy was posting on two of them. Reading his post, day after day. I decided that this P.R. guy either part of the scam, or just a knuckle head. As I continued to read week after week .His post on the message boards, got more angry and more angry, with each line he wrote, toward this otto guy (CEO of the company).

I thought to my self, maybe its just a power struggle. Or he was out to get more money from him(otto). Begin a small business owner, I have dealt with this mentality on almost a weekly bases. during this time, other posters on the message boards that were loyal to this P.R. guy had become flip flopper's and were getting very angry at this P.R. guy.

This otto guy disappeared off the planet, at this time I had begun to think that this P.R. guy had every right to be angry and I found myself beginning to understand what the P.R. guy was saying and feeling.

The P.R. guy was kicked off of the message boards, and then he opened up a myspace page, and was blogging there. I followed ,and my daughter noticed that I was on myspace. And she told me that I can have a myspace page too. So she made me one, and the P.R. guy and I began to talk. He seemed like a very humble man to me ,but at the same time very focused on what he wanted to do. And that was to take control of the company.

I don't know why, but I continued to accumulate shares at 0.002 and 0.003 all tho he had told me, he was upset over what this otto guy had done to the share holders, that had trusted in him (otto) I wanted to see what made this P.R. guy tick. Is he honest? Does he have a dark hidden agenda? Was he going to pump it up and then dump his shares? I thought not, I was beginning to like this guy so I stared talking to him over the phone. At this time he was very forth coming with information about otto, the company, and about what had happened between him, otto, and the company. I began to feel his pain and I had realize that he had been con by the CEO (otto) he informed me of the press releases that were releases without his knowledge while making it appear that the P.R. guy was the one responsible for the press release.

We continued to talk over the phone every once in a while as well as a little chit chat on the myspace page as time went on he had done alot of networking and he had gained confidence over the largest shares holders as well as mine. I continued to accumulate shares. I knew that he had his work cut out for him. He told me about all the skeletons he was uncovering. As he would crush one another would pop up but without giving me all the details of each problem. He had finally taken control of the company, and all the open information had stopped. Which in my opinion was proper.

At this point I had stopped buying the stock. And not due to lack of faith in his abilities, but at this point i had invested over $12,000.00. And was holding over one million three hundred thousand shares. After a few months of this guy's up hill battles, scrambling to fix the companies problems, and deal with the bad debt, he announced a share holders meeting.
It was going to be held over the fathers day weekend. I thought to myself, what a prefect opportunity. To go to the share holders meeting, along with treating my 16 year old daughter to a three day mini vacation/father- daughter time, for some beach time and shopping.
Mean while back on the message boards, all were excited about the share holders meeting, and over 15 people posted, stating that they were going to the meeting. The mood quickly changed as people started making fun of the share holders meeting all tho he was very up beat about the meeting and the company, the posters continued to the bash him, and the company. I found this to be strange, for he was the only person that was willing to try and fix the companies problems, and inevitabilty saving all of the share holders invested dollars. One poster even posed that she should take over the company, (I thought to my self, with no inside information, $250,000.00 in debt) she must be crazy. At times i even thought this guy was a little crazy, for taking on such an overwhelming task, saving a public company which is nothing, and make it into something. To do all this not just for himself, but to make sure the share holders did not lose there money.

It was time for the share holders meeting. So off we went to Florida. And just three share holders including myself had showed up. What happened to the other twelve people? Just big timers on a message board with nothing better to do as I had thought in the beginning. Meeting Mr. Jeff Berkowitz and his family, Mr. Wayne Pederson, and Mr. Paul Joseph, I will never forget. I was so impressed with how Mr. Joseph and Mr. Pederson stood behind Jeff.
Jeffs' family were, and are great people. It was a pleasure meeting them. Jen, went way out of her way to make sure that my daughter had fun, and was comfortable in her new surroundings, with a bunch of strangers. However, after two hours at Jeffs' house, there were no more strangers. I met several of Jeffs' friends, and they were all really nice people. we went to his house to have a BBQ and we cooked out hamburgers. In Texas that's called grilling. A BBQ is when you start up the smoker and smoke brisket all day and drink beer and sit in the shade, and tend to the smoker. This event prevents you from getting in trouble from your wife while drinking beer all day, because your working. Beginning originally from New York, I knew Jeff did not understand this Texas tradition. Therefore i said nothing and enjoyed the cold beer, the hamburgers, and the company.
Jeff had paid a teenager from the neighbor hood to do the cooking for him and Jen. So that they could visit with everyone, however Jeff ended up staying out there with him and helped him cook. Jeff introduced his youngster to all of us as equals all these small little things that most people don't pay attention too, impressed me. It was the sign of a good man with a good heart. I have always believed that you should treat others the way you would want to be treated. He obviously believes this as well. At this point I have became a JB fan.
He told me at the meeting, and over the phone, that there was just so much he could do, with out money. To add more debt to the company was out of the question. After the meeting was over, the people on the message boards, chopped him up into little pieces. Over having just three people show up at the share holders meeting/party, and a fourth person who was a miner. At the same time, Jeff and his wife Jen, were telling me how much they had enjoyed having my daughter and I, over at there house at the party.
While fixing most of the problems with EZ2, his phone, I know would ring off the wall, and he told me he talked to any share holder that called. I knew that his plate must be full, so I stopped calling him. All tho he told me to call at any time, I knew he needed the break.
I'm very impressed with this P.R. guy, Jeff. And I consider him a friend. This story may not be exactly historical accurate. Its just the way that I see this story progressing. In my opinion we are about to conclude chapter four of the story and move on to chapter five.
